These Terms and Conditions (“Terms”) apply to all quotations and services provided by Capetivated PTY LTD (“we”, “us”, “our” or “the Company”). By accepting a quotation, the client (“you” or “the Client”) agrees to the following:

1. RESPONSIBILITIES OF CAPETIVATED (PTY) LTD

1.1 Service Delivery

We will deliver the experience as described in the confirmed quote, including transportation, guided tours, activities, and any inclusions specified in writing.

1.2 Health and Safety

We take reasonable steps to ensure your safety, including partnering with reputable and licensed service providers and ensuring guides or facilitators are experienced and qualified.

1.3 Communication

We will provide clear pre-trip information and maintain open communication throughout the planning and execution of the tour.

1.4 Insurance and Legal Compliance

We carry public liability insurance and comply with South African tourism regulations. However, our insurance does not replace your personal travel or medical cover.

2. RESPONSIBILITIES OF THE CLIENT

2.1 Booking and Payments

For single day tours, payment is required 48 hours prior to departure. For multi day tours, to confirm a booking, a non-refundable deposit of 25% is required. The remaining balance must be paid no later than 14 days before the scheduled experience. Late or incomplete payments may result in cancellation. Tours are quoted in ZAR Rand and the client is responsible for any losses incurred due to exchange rate changes.

2.2 Travel Insurance

Clients must have personal insurance to cover medical emergencies, cancellations, theft, or personal loss.

2.3 Medical and Special Requirements

You must inform us in writing of any medical, mobility, allergy, or dietary issues at least one week prior to the experience so we can do our best to accommodate your needs.

2.4 Conduct and Cooperation

Clients are expected to behave respectfully towards guides, service providers, fellow participants, and the environment. We reserve the right to remove disruptive individuals without refund if safety or group enjoyment is affected. 

2.5 Punctuality

You are responsible for arriving at designated meeting points on time. Delays caused by the client may result in shortened activities without compensation.

3. CHANGES AND CANCELLATIONS

3.1 Client Cancellations

If you cancel your booking in writing, the following applies:

  • Day Tours:

More than 48 hours in advance – Full refund

             Less than 48 hours prior to departure – No refund. 

  • Multi day tours:

More than 30 days before experience – 75% refund

14 days before – 50% refund

Less than 72 hours – No refund

We may offer credits or rescheduling where possible, subject to availability and fairness.

3.2 Company Cancellations or Changes

We reserve the right to change or cancel an experience/activity or tour due to unsuitable weather conditions, safety, or operational issues. We will provide an alternative date, activity, or a full refund if no suitable alternative is available.

3.3 Proposed itineraries are subject to slight changes based on availability at the time of booking. Bookings can only be confirmed once the quote has been accepted, the terms and conditions have been signed, and the required deposit has been received.

4. FORCE MAJEURE

We are not liable for changes, delays, or cancellations caused by events outside our reasonable control, including but not limited to natural disasters, severe weather, war, strikes, lockdowns, civil unrest, or government actions. In such cases, we will offer a credit, rescheduling, or partial refund where feasible.

5. ACCIDENTS AND EMERGENCIES 

5.1 Acknowledgement of Risk

Many of our experiences involve outdoor or adventure activities. While we prioritize safety, participation is at your own risk, and you acknowledge that accidents may occur despite precautions.

5.2 Response to Accidents

In case of an accident or emergency, we will provide or coordinate first aid and emergency assistance. You agree to follow safety instructions and guidelines provided by staff or guides at all times.

5.3 Liability Limitations

Capetivated PTY LTD is not liable for personal injury, illness, loss, theft of valuables or damage unless caused by proven negligence or willful misconduct. This limitation is in line with South African tourism standards and consumer protection laws.

6. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa. Disputes will be resolved amicably where possible, and otherwise submitted to the courts of the Western Cape.
